TAWAU: The Domestic Trade and Consumer Affairs Ministry (KPDN) Semporna successfully concluded another case of smuggling controlled goods, as the Tawau Magistrate’s Court sentenced two men to five (5) months’ imprisonment for possessing 170 kilograms of cooking oil without lawful authority.
The accused, Felsing Bin Abdul Murin and Lichin Bin Felsing, both unidentifiable by any documentation, were found guilty under Regulation 3(1) of the Control of Supplies Regulations 1974 for dealing in bulk or retail of controlled items—namely, 170 kilograms of cooking oil—without a licence or approval from the Supply Controller.
The case was investigated by PmP Zulkifli Baco, with prosecution proceedings handled by Officer of the Ministry of Home Affairs and Cost of Living (KPDN) Semporna Branch, PPP Samat Bin Mapiare @ Muparia. Both defendants did not have legal representation.
The offence was committed on 28 February 2026, around 4:40 pm, in the waters off Pulau Mataking and Pulau Boheyan, Semporna, Sabah. The arrests were made by the Kunak Operations Force (PGA) following inspections, and the case was handed over to the KPDN Semporna Branch for further action.
Judge Y.A. Tuan Ahmad Faizadh Yahaya ordered a five-month prison sentence starting from the date of arrest. Upon completion of their imprisonment, both suspects will be handed over to the Malaysian Immigration Department for further processing.
Additionally, the 170 kilograms of controlled cooking oil has been ordered to be sold and proceeds retained by the government. Other confiscated items, including a pump boat and engine, have been forfeited to KPDN under Section 26(1) of the Control of Supplies Act 1961.
“The KPDN will not compromise with any individuals or syndicates involved in smuggling activities. Strict actions will be taken to ensure the stability of supply and to protect the interests of the rakyat,” asserted the Head of KPDN Semporna Branch, Tuan Satunlucy Bin Lamioh @ Lamidah.
