PBS Hails High Court Ruling: A Milestone for MA63 and Constitutional Justice

KOTA KINABALU: Parti Bersatu Sabah (PBS) welcomes today’s landmark High Court decision in favour of the Sabah Law Society (SLS) regarding Sabah’s 40% entitlement under Articles 112C and 112D of the Federal Constitution.


The ruling reaffirms the Federal Government’s constitutional and moral duty to uphold the Malaysia Agreement 1963 (MA63) and the founding principles upon which the Federation was built.


Acting PBS President, Datuk Seri Panglima Dr Joachim Gunsalam, expressed the party’s deep appreciation and congratulations to the SLS for its steadfast commitment and courage in pursuing the judicial review.


“PBS commends SLS for standing firm on behalf of all Sabahans. This decision is a victory not only for the rule of law but also for the spirit of fairness, equality, and partnership enshrined in MA63,” Dr Joachim said.


He stressed that the judgment validates what Sabahans have long maintained, that the 40% entitlement is not a privilege, but a constitutional right guaranteed to the state.


“For nearly five decades, this right has been neglected and delayed. The time has come to correct this historical oversight and fulfil the constitutional promise made to the people of Sabah,” he added.


PBS also called on the Federal Government to fully comply with the Court’s directives, to begin a proper review within 90 days and reach an agreement with the Sabah Government within 180 days regarding the revenue due from 1974 to 2021.


“The Court’s order must be respected without further delay or excuses. Justice delayed is justice denied,” Dr Joachim emphasised.


He further noted that this issue transcends politics and should unite all Sabah leaders in defending the state’s constitutional and fiscal rights.


“PBS has consistently championed the restoration of Sabah’s rights under MA63. This judgment is a significant step forward in restoring balance within our Federation,” he said.


In conclusion, PBS reaffirmed its full support for the SLS and the judiciary for upholding the rule of law and protecting Sabah’s rightful place in Malaysia.


“Let this mark the beginning of a new era of sincerity and fairness between Sabah and the Federal Government. After 48 years, it is time to honour our agreement and uphold the Constitution,” Dr Joachim concluded.
