Sandakan Magistrates' Court Acquits Money Lending Supervisor of Fraud Charges

SANDAKAN: Gui Chee Wai, a 33-year-old supervisor at a local money lending firm, has been acquitted of four charges of deception under Section 417 of the Penal Code at Sandakan Magistrates’ Court.
The case, which began proceedings on 13th February 2025, saw the prosecution call five witnesses to establish its case against Gui. However, after careful consideration of the evidence, the prosecution failed to prove a prima facie case, leading to the defendant’s discharge and acquittal at the conclusion of the trial on 5th December 2025.
The charges stemmed from allegations that Gui used the names of four individuals to fraudulently secure loans from his employer, Tasek Reka Sdn Bhd, a licensed money lender regulated under the Moneylenders (Control & Licensing) Regulations 2003.
The alleged offences involved claims that Gui knowingly submitted false information to obtain loans amounting to RM 39,000, RM 12,500, RM 7,500, and RM 17,740, despite the loans not existing in reality.
The court, presided over by Magistrate Nur Faezah Jafry, found that the prosecution’s evidence did not sufficiently establish that Gui committed the offences. As a result, he was formally discharged and acquitted of all four charges.
