KENINGAU: The firm stance of the Sabah State Government in opposing the Federal Government’s application to stay the implementation of the High Court Order regarding the review and determination of Sabah’s 40 per cent net revenue rights from the Federation for the period 1974 to 2021 is lauded.

The Chairman of the Bingkor Community Welfare Association, Yazid Mohd Hasnan Tawik @ Charles, stated that the High Court decision dated 17 October 2025 is not merely an administrative ruling, but a judicial decision that must be respected and implemented without any delaying tactics.

According to him, any attempt to delay the implementation of the court decision will only create the perception that Sabah’s constitutional rights continue to be sidelined, even though the matter has been determined through proper legal channels.

“It will create the perception that Sabah’s constitutional rights continue to be sidelined, even though it has been determined through legal channels,” he said in a statement.

Yazid emphasised that Sabah’s 40 per cent net revenue rights from the Federation are enshrined in the Federal Constitution and align with the spirit of the Malaysia Agreement 1963 (MA63).

It is not merely a new claim or a matter of political negotiation, he said, adding that the people of Sabah have waited too long for justice on this issue, often referred to as the “Missing Years”.

Any further delay in implementing the court decision is unjust and contravenes the principles of justice and the rule of law.

“The Federal Government should demonstrate clear political commitment by implementing the court decision in stages if there are financial constraints, rather than seeking a stay,” he stressed.

In this regard, he called on all parties to respect the nation’s judiciary and ensure that Sabah’s rights are fully implemented to guarantee justice, federal stability, and the well-being of the state’s people.

“Sabah’s rights must be respected and the court decision must be implemented,” he said.
